2. The app on your device
Recordings, settings and credentials stay on your device. The microphone is used for recording and for the level meter; you can revoke the permission in the Windows settings. The app sends no usage or diagnostic data.
3. Customer account and licence
Using RecSimple requires a customer account. For it we process your e-mail address, your password, the status of your subscription and the registered devices. The purpose is the performance of the contract with you, including the e-mails required for it (Art. 6(1)(b) GDPR); protection against abuse is based on our legitimate interest (Art. 6(1)(f) GDPR). We delete the data when you delete the account. A pseudonymised identifier remains stored to limit the trial period for as long as we offer a free trial. Withdrawal declarations are retained for seven years (section 132 Austrian Federal Fiscal Code, Art. 6(1)(c) GDPR). RecSimple cannot be used without an e-mail address.
4. Payment via Stripe
Subscriptions are processed by Stripe. You enter your payment details directly with Stripe; we receive no card or bank details. We transmit to Stripe your e-mail address and the chosen plan. Stripe processes partly on our behalf and partly under its own responsibility (stripe.com/en-at/privacy) and may transfer data outside the EEA, based on the EU standard contractual clauses; a copy is available on request at the e-mail address above. Invoice data is retained for seven years. Legal basis: Art. 6(1)(b) and (c) GDPR.
5. Signing in with Google or Microsoft
If you choose this option, the provider gives us a user identifier and your e-mail address. The provider's own privacy policy applies to the sign-in itself: Google or Microsoft. Our legal basis: Art. 6(1)(b) GDPR.
6. Web customer account
Signing in to the web customer account sets a technically necessary session cookie (section 165(3) Austrian Telecommunications Act 2021, Art. 6(1)(b) GDPR).
7. Recipients
The licence server and the website are operated by hosting providers in the EU (data processing under Art. 28 GDPR). The other recipients are Stripe (section 4) and, if you choose them, Google or Microsoft (section 5). We do not transfer data to third countries ourselves; when you pay via Stripe (section 4) or sign in with Google or Microsoft (section 5), those providers may transfer data.
8. This website
recsimple.com sets no cookies. The web server records access data for technical reasons to operate and secure the site (Art. 6(1)(f) GDPR); the logs are deleted after 14 days at the latest.
9. Your rights
You have the right of access to your stored data (Art. 15 GDPR), to rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18) and data portability (Art. 20). Please contact office@smartbit.at. You can also delete your account and devices yourself at any time in the web customer account.
Right to object. You may object at any time, on grounds relating to your particular situation, to processing based on our legitimate interest (sections 3 and 8) (Art. 21 GDPR).
If you believe that the processing infringes data protection law, you can lodge a complaint with the Austrian Data Protection Authority (dsb.gv.at). No automated decision-making, including profiling, takes place.
10. Changes
If functions, providers or the law change, we adapt this policy. The current version is available at recsimple.com/rechtliches/datenschutz-en.html; the date above shows the version.
